Going back to your original enquiry about bringing your kids. In my opinion it's not immigration that you need to worry about but the possibility of you being charged at a later date with kidnapping your own children. It's happened to two people here that I know of and was messy and exspensive to resolve. In both cases the 'other half' gave a verbal OK when they were asked originally. It sounds to me as though your lawyer is not really checking but passing the buck.

My kids are 11 and 6 cheers for the info, i'll check out the web site, I knew I had to inform them when I leave but if I am only moving temp I can continue to get family allowance for 3 months but was unsure if Tenerife was classed as being in or out the EEA. I knew about the pension part as my mother is also coming over she has paid a deposit on an apartment as you have to do, and is in the process of selling her house over here, she is retired therefore will be drawing her pension form the uk. My circumstances are different hence the reason for all the questions over the past few days. I do know quite a bit but I suppose clarification from hat I have heard word of mouth is really what I'm after.
I also know that my state pension in the Uk and any private ones will be Frozen when I move I would then pay into the spanish system and accumulate another pension over there.
There are So many things to think about and find answers on isn't there all before I can decide to go ahead and put my house on the market.

dianne, bearing in mind what rob has said and how legal systems round the world all work differently i would strongly advise visiting a family law specialist and using one of their lawyers if possible, as your lawyer dosnt seem to want to get involved. is he/she just a normal lawyer or do they specialise in anything?

it will be a best idea to get that sorted and paperwork signed by your ex just to say its fine you take the kids etc.. do you know of any specalists in your area?

they will then be able to confirm all the legalitiys that you need to know.

where abouts do you live? i know of some specalits in my area if thats a help for you

there are some questions on there but the only one i could find relevant is if you had taken them without his consent which dosnt really help however it does say he would need to contact a family law soliciter so maybe one of the guys i found would be able to help?

you never guess, had a look at your list and my lawyers practice is on it albeit another lawyer from same firm seem to specialise, I'v e mailed a few comments from the forum that I pulled into an e mail to my lawyer and asked her if she can help or point me in the right direction, will let the forum know how I get on............

I really hope you do get things sorted Dianne, but I do think you have a few additional problems than others in respect of your children and ex etc.

I don't want to say too much on here, as the people I am referring to sometimes look on this forum. Theirs has been a very sad stay here in Tenerife, they listened to the wrong people (so called experts) in the UK and also the wrong people here (once again so called experts) They have been here just over two years, have spent all their savings, could not find work, or should I say work that pays enough for them to live here, so they used their saving to top up their wages. They have an apartment here they cannot sell and even when they do it will not put them back on the property market back in the UK.

They are having to take their children out of Spanish school here, the children do not want to leave, they have also missed so much from the English curriculum, they are at exams stage. They will have to stay with family until they can find jobs in the UK and maybe rent somewhere and are still stuck with an apartment here that they are paying out on. Although all the agents tell you the letting potential etc, this is not always the case, people are struggling in some areas, like here in Palm Mar to rent out at all.

So PLEASE PLEASE Dianne make sure you have got everything covered before you move out. Obviously as you say you have to sell your house etc, I know lots of people are offering lots of advice but please make sure you cover yourself. I can see you are doing a lot of homework (which maybe I got wrong on another post to you) and people here on the forum are being really helpful, but nothing beats proper legal advice insofar as your additional problems are concerned. I really totally agree with Rob on this issue.

Having children makes the whole move so much more complicated. With us we are semi retired and did not have any mortgages etc but even still it has not been easy. I repeat again I am not being negative but being honest. I would hate to see all your's and your children's dreams dashed by inadequate and unprofessional advice.
