Fiona has tenants in her apartment without a contract. Ask your lawyer what her position is!!!

I never tell people to go ahead and take a chance because I'm optomistic. People ask for advice and I give it, I do not take risks for other people. Many times people on here ask for advice in the hope that we'll agree with them and get upset when the answer is not the one that they're hoping for. Better that than a calamity.

What is the point of having a specified contract if tenants can stay for 5+ years.

If the contract is for 12 months then YOU check your facts. If the contract is for 6 months, no problem.

If you read what was actually written instead of what you think was written, you will see that Fiona has not signed a 12 month contract, she is arranging with the estate agent to sign a 6 month contract. After 5 months she will arrange to give the tenants one months notice. What is the point of having a specified contract if tenants can stay for 5+ years. Fiona does not have a problem and she didnt think she did until you answered her post, she was just checking what she had already been told. I suggest you read 'You and the law in Spain' by David Searl'. The very informative book is written by a Spanish Lawyer and updated every year. Fiona was perhaps a little gullable, which is understandable as she was only in Tenerife for a short time. Her estate agent will make sure everything is above board and done correctly. The last thing she needs is someone like you worrying her unnecessary. You are trying to tell her what WILL happen instead of what could happen if things are not handled correctly. Is your glass always half empty? Its a very sad way to live!


Hi Penny, welcome to the forum. Its quite rare for anyone to actually demonstrate a single digit I.Q. in their very first post, but you've just gone and managed it all the same. Rolling Eyes

Your responses are both unnecessarily rude and moreover, COMPLETE NONSENSE. Nobody suggested that Fiona had signed a 12 month contract. If YOU bothered to read what was said, you will see that the agent is clearly trying to railroad her into signing a 12 month contract. Fiona came on here in the first place to seek advice as to the effect of this (quite sensibly too).

The overwhelming advice from those on here with an I.Q. higher than a garden knome (including now myself) is for Fiona NOT to sign for 12 months, but to change it to the required 6 months.

Again, if you'd bothered to read the earlier posts, you would see the reason for needing a 6 month clause is that Fiona WANTS THE PROPERTY FOR HERSELF IN 6 MONTHS TIME !!! If she signs the contract as its stands, she will have NO chance of getting in at the end of 6 months.

Now please quieten down and let the grown-ups have a proper conversation Laughing

mmh the cynical part of me thinks that someone may have an vested interest in Robs advice not being taken as it was intended.....does that make my glass half empty ?

Oh well at least if it is half empty it would means that my assetts would stay safely where they should be !

I personally do not have experience in the Spanish Rental market however being an underwriter for buy to lets and a landlord myself in the UK I know that NO ONE should be allowed into a house without having a sound contract signed and checked BEFORE they step foot over the door....

I would be checking everything and double checking and checking again... before I signed anything.... I would also be questioning WHY would a professional estate agent would send out a contract for 12 months when only 6 months had been agreed.... ?!? Mhhh cynical again, but rather safe than sorry !

I wonder why she's been very silent on a couple of questions?

So do you think if I throw in a couple of grandiose and entirely inappropriate words into my posts that I could double my I.Q from 5 to 10 as well? Laughing You're fooling nobody!

If your English were that good, you would have known that the correct grammar is "Another one WHO likes his glass half empty". But the copy of 'My First Thesaurus' that you got free with the Daily Mirror probably didn't come with a Guide to Grammar...

So get your facts straight and take your 'half-full' glass, top it up with some 'calm-down' juice and go and darken someone else's forum.

Just to add my tuppence worth: Do you know Fiona's estate agent? I do not want to tarnish all agents with the same brush but I know that not all estate agents will ensure that "everything is above board and done correctly".

And Fiona knows Rob and the rest of us and knows we are only trying to look our for her because we care. We would rather she worried now than have big problems later.

Well said Jenny. Does anyone honestly believe that the majority of estate agents on this island are on the side of right and virtue?? The majority (although not all by any means) are cowboys and shysters eager to separate tourists and ex-pats from their hard-earned cash any way they can. A lot of the lawyers don't seem much better, come to that!

In this instance, the fact that Fiona's estate agent is trying to suggest that it doesn't matter that the contract says 12 months because you can still give notice after 6 months (which is utter nonsense!), then why not put 6 months in the contract in the first place if there's nothing to hide?? This estate agent is most certainly not interested in "making sure that everything is above board and done correctly". I suspect quite the opposite in fact.

So most of us with half a brain on the forum will continue "worrying people" with the truth and the facts. For those that would rather indulge in fiction, feel free to visit your local 'expert' sitting in your nearest Estate Agency or British bar, who must of course know everything about Tenerife because he or she seems like such a nice person... Rolling Eyes

Sorry Penny, but Rob etc are correct on this one. The contract must clearly state '6 months' if Fiona wants any chance of regaining possession at the end of that period.

I also agree that this agent does not appear to have Fiona's best interests at heart.

Penny, you may think its sad for someone to log onto this forum everyday, but for some of us who are making a big move over to the island this forum has been extremely helpful and has made me see that its not going to be easy!! Id rather hear the harse truth in any situation then a sugar coated dream. It seems you have issues, and where this thread was openned by someone asking for serious advice all you have done is mouth off people in this forum like your the BIG I AM!

Please either grow up or go to the section for junior reefers and learn some manners
